The information on this website is provided for general information only. Clinical Books has provided this information for the benefit of users in good faith and with reasonable care. Errors and omissions in this information may occur including through negligence. Clinical Books does not accept any liability for any loss or damage which may directly or indirectly result from any opinion, information, advice, representation or omission contained on this web site.

By purchasing products from Clinical Books or using this website the purchaser (“The Customer”), agrees to the following terms and conditions of sale.

  1. Consumer Guarantees Act 1993: Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply
  2. Business Customers: The Consumer Guarantees Act 1993 does not apply to business customers (where “business” is as defined by the Act). Business customers agree that where products are purchased for the purpose of a business that the Act does not apply.
  3. Limitation of Liability: The Customer shall indemnify Clinical Books against any loss of or damage to property or for data or software which is lost, corrupted, deleted or altered. Clinical Books shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services, even if Clinical Books has been advised of their possibility. In no case shall the maximum liability exceed the cost of the original order.
  4. Refunds: Refunds will be given at our discretion.
  5. Addressing: If a product is found to be mis-addressed by Clinical Books then we will be responsible for the re-delivery, replacement or refunding of the product. If the Customer is found to have given an incorrect or insufficient address, then Clinical Books will not refund or resend the product and all responsibility for correcting delivery will be borne by the Customer.
  6. Incorrect Bank Account Number: Clinical Books gives the customer the choice to pay for products through bank transfer. If the Customer credits money to the incorrect bank account number, and the correct number was provided to the Customer by Clinical Books, then Clinical Books will not accept any responsibility for correcting payment and the goods will not be dispatched.
  7. Mailing Cash: Clinical Books does not recommend that cash be mailed for payment of products. If the Customer does mail cash, Clinical Books accepts no responsibility for the theft, loss or otherwise non-delivery of mailed cash.
  8. Cancelling Orders: Clinical Books reserves the right to cancel orders that we believe to be fraudulent or constitute a mis-use or a promotional or marketing activity or where an error has occurred including but not limited to errors relating to pricing.
  9. Delivery Estimates: Clinical Books makes every effort practical to ensure that delivery timeframes given are accurate. However the delivery times stated for products on this site assume that the stock availability information provided by our suppliers is accurate and that delivery times are not adversely affected by unforeseen events. By placing an order, you agree not to hold Clinical Books liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
  10. Communications: By creating an account with Clinical Books you consent to receiving electronic communications from Clinical Books. These communications will include: account status updates, order status updates, promotional and marketing materials, and other information relating to the service. Your personal details will not be made available to any third party. For more information please see our privacy policy.

Your details

When you register with Clinical Books website, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.

If any of your details change, such as your credit card billing address, you may update your details by logging in to your account on The Clinical Books website, and updating your details

The Contract Between Us

Any contract for purchases made through Clinical Books website will be online unless it is at our clinic.

Clinical Books must receive payment of the whole of the price for the goods that you order before your order can be accepted. Payment is taken at the point of order in Australian Dollars (AUD). Once payment has been received Clinical Books will confirm that your order has been received by sending an email to you at the email address you provide. The order confirmation email will include your name, the order number and the total price. Clinical Books acceptance of your order brings into existence a legally binding contract between us on these terms.

Your Right of Cancellation

You can cancel your order without giving any reason prior to the goods being shipped. You must notify us of your cancellation. You can notify us by contacting us here

We will refund the price of the item no later than 3 days from the day on which we receive your cancellation. We will refund the same means of payment as you used to make your purchase. Please see Returns / Refunds for how to return items you have received for a refund.

Availability of Goods You Order

If Clinical Books has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible. You may choose between a refund or wait for the item to come back into stock. If you choose a refund, any sum debited by Clinical Books from your credit card will be re-credited to your account and Clinical Books will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Clinical Books will not be obliged to offer any additional compensation for disappointment suffered.

Delivery of Goods to You

Clinical Books will post the goods ordered by you to the person and address you give Clinical Books at the time you make your order. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of dispatch of the order. All delivery times quoted on the web site are estimates only, based on availability, normal processing by Australia Post. You will become the owner of the goods you have ordered when the goods are dispatched to you from our retail store.

Goods and Services Tax (GST)

All prices displayed on Clinical Books website are inclusive of Australian GST (10% or 1/11 of the total price).

Goods sold by Clinical Books that are dispatched to addresses outside Australia are not subject to Australian GST. When ordering goods from Clinical Books for delivery overseas, you may be subject to import duties and taxes that are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be.

Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Clinical Books, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Liability

This is as follows:

If the goods Clinical Books delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Clinical Books shall have no liability to you unless you notify Clinical Books in writing using our contact form here of the problem within 14 working days of the delivery of the goods in question.

If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you, Clinical Books shall have no liability to you unless you notify Clinical Books in writing using our contact form here of the problem within 40 days of the date on which the goods were dispatched to you.

If you report a problem to Clinical Books under this condition, Clinical Books only obligation will be to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment. In the case of theft of goods at or near your delivery address you must assist Clinical Books by reporting any such theft to police in your local jurisdiction. In the case of theft of goods Clinical Books shall have no liability to you unless you provide Clinical Books in writing using our contact form with a valid police report number.

Clinical Books will not be liable to you for any indirect or consequential loss or damage arising out of any problem you report to Clinical Books under this condition and Clinical Books shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph above.

Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit The Clinical Books liability to you for any death or personal injury resulting from its negligence.

Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.

Complaints

Clinical Books operates a complaints handling procedure which is used to try to resolve disputes when they first arise. If you have a complaint, please contact us here.

Governing Law

The contract between us shall be governed by and interpreted in accordance with Australian law, and the Australian courts shall have jurisdiction to resolve any disputes between us.

Technical

The nature of Internet communications means that your communications may be susceptible to data corruption, interception and delays. Clinical Books shall not be responsible for any detrimental reliance you place on this website or its contents.
Clinical Books is providing this site and its contents (including any downloadable data or software) on an ‘as is’ basis and makes no representations or warranties of any kind with respect to this site or its contents and disclaims all such representations and warranties, whether express or implied, to the fullest extent permitted by applicable law. In addition, Clinical Books makes no representations or warranties about the accuracy, completeness or suitability for any particular purpose of the information and related graphics published in this site or that any software or the server that makes it available are free of viruses or other harmful components. The information contained in this site may contain technical inaccuracies or typographical errors.
